A Durham man has pleaded guilty to shooting and killing a 5-year-old in July 2023 and to the attempted murder of her babysitter. 

Brian Luster was initially charged with first degree murder in 2023. Records show that on Aug. 12, Luster pleaded guilty to a lesser charge in the murder of Khloe Fennell. Records show he also pleaded guilty to the attempted murder of Destiny Sidberry, who was babysitting Khloe at the home at the time of the shooting.

Luster, who has been behind bars without bond, is the cousin of Brittany Dash, Khloe's mother, and was living with them at the time of the shooting.

On July 5, 2023, police responded to the home on North Guthrie Avenue. Police were originally called to the scene for a drug overdose.

Sidberry, who was 15 at the time of the shooting, was hospitalized in critical condition. Khloe was killed.

A friend told WRAL News at the time that Sidberry was watching Khloe and another child at the home when Luster showed up.

Luster has a long criminal record dating back to 2001 and has faced more than 50 charges since he was 19.

A next court date was scheduled for Dec. 17.
