Brian Izael Cruz is facing felony secret peeping, sexual battery and indecent exposure charges for an incident at a Kohl's in Apex earlier this month.
According to a warrant, Cruz secretly photographed or recorded a woman in the department store without her knowledge or consent. He also exposed himself to the woman during the encounter.

The warrant shows the incident occurred on April 16.
Apex police arrested Cruz on April 28. Officers said their Automated License Plate Reader system alerted officers that a vehicle connected to Cruz was in the area.
Cruz is being held without bond in the Wake County Detention Center.
A judge denied his request for bond on Wednesday.
When making his decision on no bond here, the judge citied Iryna's Law, adding that when it comes to a charge that could place a person on a sex offender registry, they are held without bond.
Shoppers at the Kohl's at Beaver Creek Commons were unnerved by the news.
"It makes me feel a little uncomfortable in places like that," said Morgan Lanuti. "Shopping is something a lot of women go to for stress relief, for fun, for retail therapy, and to have someone kind of exploiting that moment is terrible."
