A WakeMed Garner police officer who died in an emergency room shooting last month is accused of shooting the man charged with his murder, court documents show.
Court documents filed on Monday state that Officer Roger Smith shot Benji Martin Jr. on Nov. 8 at the WakeMed Garner Healthplex.

“Martin remains housed in the medical unit at the Detention Center due to the need for ongoing medical treatment,” one of the documents states. “Mr. Martin requires necessary medical supplies to ensure that his wounds are cared for properly and to avoid any further complications.”
The motion filed by Durham-based lawyer Emilia Beskind on Martin’s behalf asks the court that Martin is provided the necessary medical supplies to treat his injuries while at the Wake County Detention Center.
“Specifically, Mr. Martin needs appropriately sized colostomy bags, other ostomy supplies to include but not limited to seal/tape, soap and any other supplies that are medically necessary to meet the standard of care when treating his ongoing medical injuries.”
Last week, a small group of protesters gathered outside the Wake County Justice Center to demand transparency in Martin’s case. It came after a grand jury indicted Martin on a murder charge.
A document from Beskind states Martin was trying to "seek help" on Nov. 8 when he entered the WakeMed Garner Healthplex and did not bring a gun to the facility.
